Barkan Research has two legal books which we publish, sell and distribute exclusively through our website: “The Colossal Book of Criminal Citations” and “The Colossal Book of Civil Citations.” Each book is designed similarly and organized by legal topic.
Our first book to be published was “The Colossal Book of Criminal Citations.” First printed in 2010, this book has advanced through multiple editions and currently contains more than 5,000 references to various State, Federal District, Federal Circuit, and the United States Supreme Court cases. Our book is 8.5 x 11 inches, softcover and available for immediate shipping. In addition to legal citations, “The Colossal Book of Criminal Citations” contains definitions to over 500 frequently used legal terms, sample motions and addresses to various innocence projects throughout the United States.
Our intent for creating “The Colossal Book of Criminal Citations” is simple: to give any individual accused or convicted of a criminal offense the opportunity to ensure justice is administered fairly. Many of our customers are incarcerated with minimal access to legal resources. Prisoners often write to share the frustration that their institution’s accessible legal material is outdated or is nearly nonexistent. We take pride in updating our books with current case law, adding new topics and building a product utilizing customer feedback.
Each new edition of “The Colossal Book of Criminal Citations” incorporates new issues requested by our customer base. For example, Arizona customers asked that a section be included to cover “Special Actions,” a procedural process unique to Arizona law. Because several requests were made regarding this topic, we researched Arizona law and incorporated a topical section for their reference.
Numerous other individuals requested that we include a topical section regarding registration for those convicted of sexual offenses. After that, we began researching various State and Federal laws about individuals convicted of sexual crimes and incorporated a section specific to this class of customers. Individuals awaiting trial have requested sample motions to be included in our book. Defendants who are pursuing Federal Habeas Corpus post-conviction relief requested a sample motion to help in their pursuit of a Certificate of Appealability. We responded by acting on this customer input. Listening to our customers has made “The Colossal Book of Criminal Citations” the preferred resource of many.
Our second book to enter publication was “The Colossal Book of Civil Citations.” First printed in 2016, this book was being requested almost immediately after our customers began using “The Colossal Book of Criminal Citations.” This book is currently published in its second edition and contains more than 2,000 references to various State, Federal District, Federal Circuit and the United States Supreme Court cases. Our book is 8.5 x 11 inches, softcover and available for immediate shipping. This book is also arranged by legal topic to complement our criminal citations book. The civil citations book is intended to analyze, file, and litigate 42 U.S.C. §1983 civil rights complaints. The reader will find all the current legal citations to litigate nearly every civil rights action encountered while incarcerated. From the denial of adequate medical care, First Amendment claims, disciplinary infractions or retaliation, every topic is covered.
Our intent for creating “The Colossal Book of Civil Citations” is simple: to give any individual who has had their civil rights trampled or abused an opportunity to ensure restoration can be achieved, even without the luxury of an assigned attorney. Like our flagship criminal book, our civil book contains definitions of over 500 frequently used legal terms. There are also sections containing relevant Federal statutes and prisoner-related addresses. This book is a fantastic resource and a desirable asset for all Federal Court civil litigants.
“The Colossal Book of Civil Citations” is filled with actual court filings to assist in submitting the initial complaint, aid in the pursuit of discovery and prepare for the trial. Most civil litigants are obligated to advance their own case through the summary judgment proceedings before a District Court attempts to recruit pro bono counsel. Consequently, the civil litigant will be undertaking a significant portion of his or her case before counsel is recruited for the actual trial presentation. An extensive amount of pre-trial discovery must be conducted using requests for production, interrogatories, admissions and/or depositions. “The Colossal Book of Civil Citations” will offer guidance to complete all phases of this process.
“The Colossal Book of Civil Citations” also explains the necessity of exhausting the prison’s grievance process before filing a civil rights complaint. Suppose a prisoner cannot adhere to the administrative grievance process due to circumstances beyond their control; in that case, this book contains the necessary legal references to contest a defendant’s motion to dismiss for failure to exhaust administrative remedies. Such exceptions might include the absence of a grievance process, failure of a facility to follow their own written procedures or the fear of retaliation if the litigant pursued redress using any available grievance process.
